1. INTRODUCTION

Welcome to Memepet. These Terms of Service ("Terms") govern your use of our website and services. By using Memepet, you agree to these Terms. If you do not agree, please do not use our services.

Memepet provides AI-powered meme generation for pets ("Digital Products") and optional physical print products ("Physical Products") through third-party fulfillment.

2. DIGITAL PRODUCTS (MEME PACKS)

2.1 Nature of Service

Meme packs are custom digital content generated by artificial intelligence based on photos you upload. Each pack is unique and created specifically for you upon purchase.

2.2 Immediate Delivery

Upon successful payment, meme generation begins immediately. The digital content is delivered to your account as soon as processing is complete.

2.3 NO REFUND POLICY

Digital products are NON-REFUNDABLE once generation begins. By purchasing a meme pack, you acknowledge and agree that:

You are purchasing custom AI-generated content
Generation begins immediately upon payment
You expressly consent to immediate performance and waive your right of withdrawal
This is in accordance with EU Consumer Rights Directive (Article 16(m))

2.4 AI-Generated Content Disclaimer

Results are generated by artificial intelligence and are subjective in nature. We do not guarantee that you will be satisfied with the output. AI results may vary and are influenced by the quality of photos you upload.

3. PHYSICAL PRODUCTS (PRINTS)

3.1 THIRD-PARTY FULFILLMENT - IMPORTANT NOTICE

Physical products (mugs, posters, canvas prints, etc.) are manufactured and shipped exclusively by Prodigi Group Ltd, an independent third-party print-on-demand company based in the United Kingdom.

Memepet acts solely as a technology platform and intermediary. We provide the interface to design your products and transmit your order to Prodigi. The actual sale contract for physical products is between you and Prodigi, not Memepet.

Prodigi is the merchant of record, manufacturer, and shipper for all physical products.

3.2 NO REFUNDS FROM MEMEPET

MEMEPET DOES NOT PROCESS REFUNDS FOR PHYSICAL PRODUCTS. By placing an order for physical products, you acknowledge and agree that:

Memepet is not the seller of physical products - Prodigi is
All refund requests must be directed to Prodigi
Memepet has no obligation to refund any amount for physical products
You accept Prodigi's terms and conditions when placing a print order
Any dispute regarding physical products is between you and Prodigi

3.3 Complete Exclusion of Liability

Memepet expressly disclaims all liability for physical products. We are NOT responsible for:

Print quality, color accuracy, or material quality
Manufacturing defects or production errors
Shipping delays, delivery times, or carrier issues
Lost, stolen, or damaged packages during transit
Customs fees, import duties, or taxes
Incorrect or incomplete shipping addresses provided by you
Product descriptions or specifications
Any issues arising from Prodigi's production, fulfillment, or shipping processes
Any dissatisfaction with the final printed product

3.4 Claims Process for Physical Products

If you have any issues with a physical product (damaged, defective, not delivered, etc.):

Contact Prodigi directly through their customer service
Provide your order reference and details of the issue
Follow Prodigi's claims and refund process

Memepet may, at our sole discretion, assist in facilitating communication with Prodigi, but this does not create any obligation or liability on our part.

3.5 Acceptance of Terms

By placing an order for physical products through Memepet, you confirm that you have read, understood, and agree to these terms. You acknowledge that Memepet is not the seller and has no refund obligations for physical products. You accept that any claims must be made directly with Prodigi according to their policies and timelines.

4. USER RESPONSIBILITIES

By using Memepet, you agree that:

You own or have rights to all photos you upload
You will not upload illegal, offensive, or inappropriate content
You will not upload photos of people without their consent
You are responsible for providing accurate shipping information for physical orders
You will not attempt to reverse-engineer or misuse our AI technology

5. INTELLECTUAL PROPERTY

5.1 Your Content

You retain ownership of the photos you upload. By uploading, you grant Memepet a license to process these images through our AI system solely for the purpose of generating your memes.

5.2 Generated Memes

The memes generated from your photos are your property. You may use them for personal or commercial purposes.

5.3 Memepet's Rights

The Memepet name, logo, website design, and underlying technology remain our intellectual property.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Memepet's total liability shall not exceed the amount you paid for the specific order in question
We are not liable for any indirect, incidental, special, consequential, or punitive damages
We are not liable for any loss of data, profits, or business opportunities
We are not responsible for service interruptions, technical failures, or force majeure events

7. PAYMENT

Payments are processed securely through Stripe. We do not store your credit card information. All prices are displayed in the currency shown at checkout and include applicable taxes where required.

8. GOVERNING LAW

These Terms are governed by the laws of the European Union and the applicable laws of the jurisdiction where Memepet operates. Any disputes shall be resolved in the competent courts of that jurisdiction.

9. CHANGES TO TERMS

We may update these Terms from time to time. Continued use of Memepet after changes constitutes acceptance of the new Terms. We encourage you to review this page periodically.
